The Milwaukee County Federated Library Board of Trustees approved (11/20/95) the following policy concerning the confidentiality of patron information.
WHEREAS, it is the mandate of Section 43.30 of the Wisconsin Statutes that confidentiality be maintained by public libraries regarding certain patron information,and
WHEREAS, the advent of CountyCat has greatly enhanced the availability of many kinds of information regarding member libraries of the Milwaukee County Federated Library System,and
WHEREAS, it is deemed necessary and appropriate to establish a uniform policy regarding the confidentiality of patron information,
IT IS HEREBY RESOLVED, that the following policy regarding confidentiality of patron information be established by the Milwaukee County Federated Library System. (All public libraries in the State of Wisconsin are required to comply with the spirit of this policy under Chapter 43).
1. Records of any publicly funded library or public library system indicating the identity of any individual who borrows or uses library documents, materials, resources or services (herein "patron") shall not be disclosed except by court order, or to persons acting within the scope of their duties in the administration of the library or library system, or to persons authorized by the patron to inspect such records, or to other libraries as qualified below.
2. A publicly supported library may disclose a patron's identity to another library for purpose of borrowing materials for the patron only if the library to which the patron's identity is being disclosed meets at least one of the following requirements:
a. The library is supported in whole or in part by public funds.
b. The library has a written policy prohibiting the disclosure of the identity of the patron except as authorized above.
c. The library agrees not to disclose the identity of the patron except as authorized below.
3. A library to which a patron's identity is disclosed under Paragraph 2 and that is not publicly supported may disclose that patron's identity to another library for purpose of borrowing materials for that patron only if the library to which the patron's identity is being disclosed meets at least one of the requirements stated in Paragraph 2.
4. Member libraries are encouraged to adopt such personnel policies as may be reasonably necessary to the enforcement of the Policy Statement.
